Choosing a Drug Crime Attorney
If you have been charged with possession or sale of a controlled substance, the most important decision you will make with respect to your case will be the attorney you choose to represent you. Often times, attorneys are interchangeable. In other words, when charged with a straightforward crime, it would not matter what attorney you picked to represent you when it comes to resolving the case.
That is not the case when charged with possession of a controlled substance. If you are charged with possession, the case turns on the probable cause for the search.
Possession and Sale of a Controlled Substance
If charged with possession and sale of a controlled substance, the government has evidence supporting that charge. The quality of that evidence will be the driving factor of the case from a Defense perspective.
Who are you alleged to have sold controlled substances to, a confidential informant (CI) or an undercover officer (UC); where did the alleged sale take place, and what is the government relying upon to determine that the sale took place?
Challenging Confidential Informant Evidence
I have tried several criminal sale of controlled substance cases. The process employed by the police in these cases must be scrutinized effectively to achieve the best outcome. If dealing with a Confidential Informant, the process of how that informant was monitored by the government during the time that they made a controlled purchase of a controlled substance while working for the police, is paramount to the case.
I have avoided trial on several cases and have been able to negotiate favorable outcomes by drawing on the experience I have with these cases in order to pinpoint various issues that arise when Confidential Informants are relied upon to charge a citizen.
These cases are unlike any other, because the government chooses you as a target, based on information of a Confidential Informant that is providing this information for a benefit. Often trading away their prison time by offering up targets to the police of their choosing and engaging in controlled buys, or buys monitored by the police, in a controlled setting.

These cases require the proper analysis to litigate effectively. Make sure you choose an attorney that has handled these matters and gone to jury trials on these matters. Again, it is the most important decision you will make regarding the case.
