BWI Charges in New York (Navigation Law § 49-a)

1. Boating While Ability Impaired (BWAI)

– Blood Alcohol Content (BAC) of .05% to .07%

2. Boating While Intoxicated (BWI)

– BAC of .08% or higher
– Misdemeanor for first offense

3. Aggravated BWI

– BAC of .18% or higher
– Misdemeanor
– Up to 1 year in jail and/or a fine of $1,000 to $2,500
– Suspension of boating privileges for at least 12 months
