Robbery Charges in New York State

New York Penal 160 defines the crime of Robbery as forcible stealing in which the accused uses or threatens the immediate use of physical force upon another person. The charge of Robbery is then sectioned into three degrees.

Robbery in the third degree: A person is guilty of Robbery in the third degree when an individual forcibly steals property. Robbery in the 3rd degree is a class D felony.

Robbery in the second degree: The forcible stealing of property and when the act is aided by another person, causing injury to any person who isn’t a participant in the act, the accused displays a weapon during the act, or if the property consists of a motor vehicle. Robbery in the 2nd degree is a class C felony.

Robbery in the first degree: The most severe Robbery charge occurs when an individual forcibly steals, and as a result, it causes serious physical injury to any person who is not a participant in the crime, is armed with a weapon, threatens the use of a weapon, or displays a firearm. Robbery in the 1st degree is a Class B felony.
