Robbery Charges in New York State
New York Penal 160 defines the crime of Robbery as forcible stealing in which the accused uses or threatens the immediate use of physical force upon another person. The charge of Robbery is then sectioned into three degrees.
Robbery in the third degree: A person is guilty of Robbery in the third degree when an individual forcibly steals property. Robbery in the 3rd degree is a class D felony.
Robbery in the second degree: The forcible stealing of property and when the act is aided by another person, causing injury to any person who isn’t a participant in the act, the accused displays a weapon during the act, or if the property consists of a motor vehicle.
