Every Ticket Here Is Negotiable. Most People Never Negotiate.

In New York City, traffic tickets go to the Traffic Violations Bureau, where plea bargaining is not allowed. Saratoga County works the other way: your ticket is answerable in a town, village, or city court, the district attorney’s office handles the prosecution, and reductions are negotiated every week. Most drivers plead guilty by mail anyway, accept the points, and find out later what that plea did to their insurance and their license.

Attorney Andrew DeLuca handles traffic matters in the same local courts where he defends criminal cases: Milton, Wilton, Malta, Halfmoon, Clifton Park, Moreau, Saratoga Springs City Court, and the rest of the county’s courts, plus Warren, Washington, Fulton, and Montgomery Counties. In most cases you will not need to appear.

The 2026 Point Rules Raised the Stakes

On February 16, 2026, the DMV changed how points work. The window for counting points toward license action stretched from 18 to 24 months, so old tickets haunt you longer. And several violations got dramatically heavier: an alcohol or drug-related driving conviction and Aggravated Unlicensed Operation each now carry 11 points on their own, passing a stopped school bus jumped to 8, work-zone speeding is 8, and leaving the scene of a personal-injury crash rose to 5. The full breakdown is on our New York license points guide.

The quieter cost is the Driver Responsibility Assessment: reach six points within 18 months and the DMV bills you $100 a year for three years, separate from any fine the court imposed. A five-point cell phone ticket plus one minor moving violation gets you there. That math turns tickets people used to shrug off into tickets worth fighting.

Andrew is responsive and takes matters into his own hands .. got the charge completely dropped for a very reasonable fee, highly recommended and would use again if needed.

Traffic Matters We Handle

  • Speeding tickets, from 3 points at 1 to 10 mph over up to 11 points above 40 over
  • Cell phone and texting tickets, 5 points each
  • Reckless driving (VTL 1212), a misdemeanor that creates a criminal record, not just a ticket
  • Aggravated Unlicensed Operation, now an 11-point conviction under the 2026 rules
  • School bus, work-zone, and leaving-the-scene charges under the new heavier point values
  • CDL drivers, where a “minor” conviction can threaten the job itself

Not sure whether your ticket is worth fighting? Start with our honest breakdown: fight it or pay it. And if your court date is coming up, the court guides cover what to expect in the local courts we appear in.
